UM/UIM Claim

When the Driver Is Never Identified

A hit-and-run, or a driver who ran you off the road without touching you, is usually handled as an uninsured motorist claim. Those claims carry conditions the ordinary ones do not.

Reporting requirements are strict and short

These claims commonly require prompt reporting to law enforcement and to your own insurer. The deadlines are short, they are conditions of coverage rather than suggestions, and missing them is a recurring reason otherwise good claims fail.

The phantom vehicle problem

Where a vehicle caused the collision without contact — forcing you off the road — some policies and states impose additional requirements, such as independent corroboration of the other vehicle's existence. A witness matters enormously in these claims.

Build the record immediately

The police report number, any witness details, dashcam footage, and nearby business cameras that will be overwritten within days. In a claim where the other driver will never be found, this evidence is the claim.

What you can do about it depends on your state

This describes the denial itself, which works much the same everywhere. Whether you can sue under a statute, what you can recover, and how long you have differ sharply — choose the state where your policy was issued.

Common questions

The driver fled and was never found. Do I have a claim?

Usually through your own uninsured motorist coverage — but report it to police and your insurer immediately, because these claims carry short reporting conditions.

Another car ran me off the road without hitting me.

That may still be covered, though some policies and states require corroboration that the other vehicle existed. A witness is extremely valuable here.
