Filing a Complaint With the New Mexico OSI
New Mexico's Office of Superintendent of Insurance handles complaints, and here the regulator's remit and your private rights overlap in a way they do not in California or Arizona.
What the OSI does
It receives complaints about insurers and enforces New Mexico's insurance code, including the trade-practices provisions.
The difference from CA and AZ
In those states the unfair-practices statute is regulatory only. In New Mexico you can also sue on it — so the conduct you describe in a complaint may be the same conduct that supports a statutory claim for damages.
Do both, carefully
Filing a complaint creates a record and may prompt a response. Because the same conduct can support a private claim here, it is worth having the framing reviewed before submitting a detailed account.
