Construction Accidents Checklist

How to Preserve the Site Evidence

The evidence that fixes responsibility on a third party — safety plans, inspection records, and the equipment — is controlled by the companies on the job and can disappear. This checklist helps; your lawyer can take on most of it.

  1. Map the companies on the job

Note the general contractor, subcontractors, and equipment companies, and who controlled the area or equipment involved. This identifies the potential third parties.

  2. Photograph the hazard and equipment

Photograph the hazard, the equipment, and the scene before anything changes, and note any equipment make, model, and markings.

  3. Preserve the equipment if a defect is involved

If a tool or machine failed, it should not be repaired, altered, or returned — it is the key evidence of a defect.

  4. Get witnesses and any reports

Collect witness contacts and any incident or safety reports, which can show what companies knew about a hazard.

  5. Get a lawyer to demand preservation fast

A lawyer can quickly demand the safety plans, inspection records, and equipment be preserved, and begin mapping who was responsible.

The deadlines and rules depend on your state

The steps above apply wherever you were hurt. Filing deadlines, fault rules, and limits on damages differ by state — pick yours for what applies to construction accidents.
